Excavated public road material exemption

The NSW EPA has recently issued The excavated public road material exemption 2012, under the Protection of the Environment Operations (Waste) Regulation 2005 – General Exemption Under Part 6, Clause 51 and 51A.
The exemption applies to:

“rock, soil, sand, bitumen, reclaimed asphalt pavement, gravel, slag from iron and steel manufacturing, fly and bottom ash, concrete, brick, ceramics and any materials that hold a resource recovery exemption for use in road making activities and that have been excavated during the construction and maintenance of council and RMS public roads and public road infrastructure facilities”.
